General terms and conditions of

Bernd Schäfer Motorsport and his partners are event and motorsport organizations.
Bernd Schäfer Motorsport commissions partner companies to organize the “KING OF GERMANY” event.

GENERAL TERMS AND CONDITIONS

1. Scope of application
1.1 These terms and conditions apply to the organization and execution of events by Bernd Schäfer Motorsport.


2. Conclusion of contract
2.1 The contract is concluded by Bernd Schäfer Motorsport's acceptance of the application and payment by the participants.
2.2 The scope of the contractual service is bindingly defined in the service description of the offer for the respective event.


3. Liability
3.1 Bernd Schäfer Motorsport shall be liable for its obligations under the contract. This liability is limited to defects in performance that are attributable to intent or gross negligence on the part of Bernd Schäfer Motorsport, except in the area of typical performance. This limitation shall not apply to damages resulting from injury to life, limb or health that are based on an intentional or negligent breach of duty - including by a legal representative or vicarious agent of the liable party. In addition, the customer is obliged to inform Bernd Schäfer Motorsport in good time of the possibility of the occurrence of extraordinary damage.
3.2 Mediated third-party services are not subject to the liability of Bernd Schäfer Motorsport. In the event of such mediation, liability is excluded unless there is intent or gross negligence.
3.3 Participants sign the following waiver before the start of the event (only the english version is legally binding):
„In consideration of the acceptance of this entry I agree that neither any one of or any combination of NORA92 Ltd and its associated clubs, the organisers, the track owners or other occupiers, the promoters and their respective officers, servants, representatives and agents (the “Parties”) shall have any liability for loss or damage which may be sustained or incurred by me as a result of participation in the event including but not limited to damage to property, economic loss, consequential loss or financial loss howsoever caused. Nothing in this clause is intended to or shall be deemed to exclude or limit liability for death or personal injury. To the fullest extent permitted by law I agree to indemnify and hold harmless each of the Parties in respect of any loss or damage whatsoever and howsoever arising from my participation in this event.“


4. Conditions of participation
Participants shall sign the following conditions of participation before the start of the event:
4.1 You will satisfy yourself before taking part that the venue and track are acceptable to you with regards to their features and layout.
4.2 By taking part you accept the risks involved in motorsport, including the risk of injury or death.
4.3 You declare that you are competent and medically fit to take part.
4.4 You declare that your vehicle is safe, complies with the regulations and is fit to use in this competition.
4.5 You do not take any drugs (prescribed or otherwise) that will impair your ability to take part.
4.6 You have read, understood, and will comply with all regulations and instructions relevant for this event.
4.7 If under the age of 18, your parent/guardian has read the above and signed opposite your name to confirm agreement with the declaration.


5. Refund policy
5.1 Once your payment is made, your registration becomes binding, and your payment is non-refundable.
5.2 All transfers of tickets or passes to another person is to be confirmed by us on beforehand and will be administered by us. Any resale or transfer of your ticket or pass done by yourself will render the ticket or pass unvalid
5.3 Bernd Schäfer Motorsport reserves the right to postpone, interrupt or cancel the agreed course for important reasons for the safety of the participants.
5.4 The participants and accompanying persons of the event agree that Bernd Schäfer Motorsport may take photographs, make audio and video recordings of the event. Bernd Schäfer Motorsport is entitled to dispose of this material free of charge, in particular for advertising purposes.


6 Applicable law / Place of Jurisdiction
This contract is subject to German law. Munich is agreed as the place of jurisdiction for all disputes arising from or in connection with a service provided by Bernd Schäfer Motorsport if the person to be sued is a merchant, a legal entity under public law or a special fund under public law. This agreement on the place of jurisdiction also applies if the party to be sued has moved its domicile or usual place of residence outside the area of application of this law after the conclusion of the contract or if its domicile or usual place of residence is unknown at the time the action is filed.
